What fence does a horse property need in Colorado?

  • Colorado lawful fence. "A well-constructed three barbed wire fence with substantial posts set at a distance of approximately twenty feet apart" (C.R.S. 35-46-101).
  • Fence-out law. Only an owner with a lawful fence in good repair recovers damages when livestock trespass (C.R.S. 35-46-102).
  • Wildlife-friendly fence (CPW). Top wire 42 inches or lower, 12 inches between the top two wires, bottom wire at least 16 inches off the ground, smooth top and bottom wires.
  • Height for horses. Colorado Parks and Wildlife: 42 inches "really is adequate to keep in nearly all breeds of horse."

Which barns and sheds need a permit in each county?

  • Jefferson County. Sheds 120 sq ft or less: Miscellaneous Permit. Over 120 sq ft or 14 ft tall: Building Permit. Every barn: Building Permit. Loafing sheds under 1,000 sq ft: Miscellaneous Permit. Three-sided ag structures up to 1,000 sq ft, 50 ft from habitable structures: permit-exempt.
  • Park County. Sheds up to 200 sq ft permit-exempt. Most properties need a dwelling first. 2 accessory structures under 5 acres, 4 at 5+ acres.
  • Clear Creek County. Sheds up to 120 sq ft permit-exempt. No accessory structure without a principal use.
  • Boulder County. Up to 120 sq ft, 12 ft tall, no utilities: permit-exempt. Ag loafing sheds permit-exempt to 200 sq ft.

Ask the seller for permits on every barn and shed. Confirm with the county building department.

When does a horse need a Colorado brand inspection?

  • Change of ownership. Every sale or transfer of a horse.
  • Moves over 75 miles. Any move of more than 75 miles inside Colorado.
  • Leaving the state. Any trip out of Colorado.
  • Cost. $5.00 per head for horses (fees effective Oct. 1, 2025).

Keep the brand inspection certificate. Counties accept it as proof for agricultural classification.

What does hay cost in the Colorado mountains?

  • Hay cost. USDA Colorado Hay Report, Sept. 24, 2026: Mountains and Northwest grass hay, fair grade, medium square bales, $300.00 per ton picked up.
  • Storage. Keep hay and firewood at least 30 feet from the house with 10 feet cleared around them (CSFS defensible space guide).
  • Winter access. Jefferson and Clear Creek counties do not plow private driveways. Hay and feed deliveries need a cleared drive.

Boulder County counts animal units per acre by zone: 4 in Agricultural, 2 in Forestry, Rural Residential and Estate Residential, and 1 horse per half acre of pasture in Suburban Residential. The code states: "Riding horses may be kept as permitted accessory uses provided at least one-half acre of pasture is available for each horse." Outdoor arenas sit 300 feet from neighbors' homes.
